AN ACT concerning
Comprehensive Health Planning
FOR the purpose of repealing the provisions relating to the
State Health Planning and Development Agency, the
Statewide Health Coordinating Council, health service
areas, and health system agencies and their duties,
including provisions as to the structure of the State
Agency, its powers and duties, the power of the
Secretary of the Department of Health and Hygiene as to
the State Agency, the duty of the Governor as to health
system agencies; repealing the provisions requiring a
health maintenance organization to obtain a certificate
of need under certain conditions, repealing the
requirements for a certificate of need, including the
requirements for hearings and appeals, creating the
State Health Planning Council, stating the purposes of
the subtitle; defining terms; specifying powers and
duties of the Council; specifying composition and
qualifications of the Council; providing for staffing,
providing for the establishment of a method of
financing the Council; and for the acceptance of funds;
requiring the issuance of a certificate of need by the
Council in order to operate certain health care
projects; providing for the appeal of decisions of the
Council; providing for the preparation and adoption of
a State health plan; and generally relating to the
administration of the State's health planning and
development functions according to relevant federal
requirement and State law.
