HARRY HUGHES, Governor                              1207

misdemeanor, and upon conviction [thereof shall] MAY be
fined [a sum not less than twenty-five dollars nor] NOT more
than [one hundred dollars] $100, or be imprisoned in jail
for not [less than ten days, nor] more than [sixty] 60 days,
or be both fined and imprisoned in the discretion of the
court; but if any [minor] UNDERAGE PERSON [shall] wilfully
[represent] REPRESENTS that he is of. full age and thereby
shall obtain any spirituous liquors, and the person selling
the same shall be able to prove at his or her trial such
misrepresentation, and that he or she used due caution in
ascertaining the age of [such] THE [minor] UNDERAGE PERSON
before disposing of the liquor [as aforesaid] to [said] THE
[minor] UNDERAGE PERSON and that in the exercise of
reasonable caution he was deceived by the use of documentary
evidence and [that] for [such] THAT reason [he] was unable
to ascertain that the [minor] UNDERAGE PERSON was in fact [a
minor] AN UNDERAGE PERSON, then the person [so] selling to
[such] THE [minor] UNDERAGE PERSON, shall be acquitted of
the [said] charge, the [minor] UNDERAGE PERSON obtaining
spirituous liquor by [such] misrepresentation of his or her
age [shall be] IS guilty of a misdemeanor and upon [trial
and] conviction [shall] MAY be [sentenced to pay a fine of]
FINED not [less them ten dollars, nor] more than [twenty
dollars] $20 and the costs of his prosecution. Any fines or
costs shall be paid pursuant to the provisions of Article
38, § 4.

123.

(b) It [shall be] IS unlawful for any licensee under
this article to allow [any minor or minors under the age of
eighteen years] A PERSON NOT DESIGNATED IN § 2(T)(2) OF
THIS ARTICLE to loaf or loiter about the place of business
for which [such] THE license is issued. Violation of this
subsection is punishable by A fine not to exceed [one
hundred dollars ($100)] $100.

125.

(a) In Garrett County licensees shall sell beer for
cash only and no suit [shall] MAY be maintained by any
retail dealer against any person for beer which has been
sold on credit. It. [shall be] IS unlawful for any licensee
to allow any [minor or minors under the age of 18 years]
PERSON NOT DESIGNATED UNDER § 2(T)(2) OF THIS ARTICLE to
loaf or loiter about his place of business.

(b) It is unlawful for any liquor licensee under this
article to employ any person under the age of [twenty-one]
21 years and for any other class of licensee to employ any
person [under the age of eighteen years] NOT DESIGNATED
UNDER § 2(T)(2) OF THIS ARTICLE in the sale of alcoholic
beverages or in connection with the business [thereof].
