20-203. REGISTRATION OF SERVICES.

A PERSON MAY NOT OPERATE ANY ABORTION REFERRAL SERVICE
UNLESS THE SERVICE IS REGISTERED WITH THE DEPARTMENT.

20-204. FEE SPLITTING PROHIBITED.

A PERSON WHO ENGAGES IN ANY ABORTION REFERRAL SERVICE
MAY NOT ACCEPT, SOLICIT, OR DIVIDE ANY FEE RECEIVED BY A
PHYSICIAN, HOSPITAL, HEALTH RELATED FACILITY, OR DISPENSARY
THAT PERFORMS OR INDUCES AN ABORTION ON ANY INDIVIDUAL
BROUGHT, RECOMMENDED, OR REFERRED TO THAT PHYSICIAN,
HOSPITAL, HEALTH RELATED FACILITY, OR DISPENSARY.

REVISOR'S NOTE: This section formerly appeared as
Article 43, §§ 129A(e)(2) and 129B(a).

The phrase "engages in" is substituted for
"permitted to engage in", to avoid the
unintentional exclusion of referral services
operated in violation of § 20-201 of this
subtitle.

The former word "business" is deleted as
unnecessary in light of the word "service".

The former word "split" is deleted as unnecessary
in light of the use of the word "divide".

The only other changes are in style.

20-205. RULES AND REGULATIONS.

THE DEPARTMENT SHALL ADOPT RULES AND REGULATIONS FOR
ABORTION REFERRAL SERVICES, INCLUDING MEDICAL STANDARDS AND
GUIDELINES FOR REFERRAL PROCEDURE AND TRAINING FOR THE
STAFF.
