sentence of former Article 43 § 952(b) and the

first sentence and the first clause of the third
sentence of (d).

Subsection (b)(1) of this section is standard
language added to state expressly that
applications may be made only on the form
required by the Secretary.

In subsection (b)(3)(iv) of this section, the
reference to the "medical director" is
substituted for "person in charge", for clarity.

As to the substitution of the term "license" for
references to "certificate" throughout this
section, see revisor's note to § 19-904 of this
subtitle and the General Revisor's Note to this
article.

The second clause of the third sentence of former
Article 43, § 952(d), which required disposition
of all fees into the General Fund of this State,
is deleted as unnecessary in light of § 2-104(j)
of this article.

19-908. ISSUANCE OF LICENSE.

THE SECRETARY SHALL ISSUE A LICENSE TO ANY APPLICANT IF
THE APPLICANT AND THE HOSPICE AND ITS MEDICAL DIRECTOR MEET
THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is standard language added
to state expressly the implied duty of the
Secretary to issue a license to a qualified
applicant.

19-909. SCOPE OF LICENSE.

WHILE IT IS EFFECTIVE, A LICENSE AUTHORIZES THE
