"certification" for operating a hospice, this
subtitle is revised to require a "license" to
reflect more clearly the apparent intent of the
substantive provisions. As to the substitution
of the term "license" for references to
"certificate", see the General Revisor's Note to
this article.

The former references "establish" and "conduct"
are deleted as unnecessary in light of the broad
reference "operate".

19-906. QUALIFICATIONS FOR LICENSE.

(A)   IN GENERAL.

TO QUALIFY FOR A LICENSE, AN APPLICANT AND THE HOSPICE
AND ITS MEDICAL DIRECTOR SHALL MEET THE REQUIREMENTS OF THIS
SECTION.

(B)  APPLICANT.

AN APPLICANT WHO IS AN INDIVIDUAL, AND ANY INDIVIDUAL
WHO IS APPLYING ON BEHALF OF A CORPORATION, ASSOCIATION, OR
GOVERNMENT AGENCY SHALL BE:

(1) AT LEAST 18 YEARS OLD; AND

(2) OF REPUTABLE AND RESPONSIBLE CHARACTER.

(C)  HOSPICE AND DIRECTOR.

(1)  THE APPLICANT SHALL HAVE A CERTIFICATE OF
NEED, AS REQUIRED UNDER SUBTITLE 1 OF THIS TITLE, FOR THE
HOSPICE TO BE OPERATED.

(2)   THE HOSPICE TO BE OPERATED AND ITS MEDICAL
DIRECTOR SHALL MEET THE REQUIREMENTS THAT THE SECRETARY
ADOPTS UNDER THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 952(c) and the second and third clauses of
the first sentence of (b) and the first sentence
of § 953(b).
