St. Mary's County - Sewer and Water Main Connections

FOR the purpose of changing the absolute right of certain
property owners in St. Mary's County to connect to a
water main or sewer service to a discretionary right at
the option of the Sanitary District Commission.

BY repealing and reenacting, with amendments,

The Public Local Laws of St. Mary's County

Section 113-9 H.

Article 19 - Public Local Laws of Maryland

(1979 Edition, supplemented to

December, 1980, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Code of Public Local Laws
of Maryland be repealed, amended, or enacted to read as
follows:

Article 19 - St. Mary's County

113-9.

H. Connection of nonabutting property. The Commission
at any time [shall] MAY, IN ITS DISCRETION, permit a
connection with a water main or sewer by a property owner
whose property does not abut on the water main or sewer and
who has not previously paid a benefit charge for the
construction of the water main or sewer, but the Commission
shall classify the property and determine a benefit charge
to be paid by the property owner as though his property
abutted upon the water main or sewer. If the connection is
made, the property owner and property, for all charges,
rates and benefits, shall stand in every respect in the same
position as if the property abutted upon a water main or
sewer.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
