BY repealing and reenacting, with amendments,
Article 10 - Attorneys at Law and Attorneys in Fact
Section 40(1)
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 10 - Attorneys at Law and Attorneys in Fact
40.
(1) In Garrett County (1) the position of POSITION OF
State's Attorney's is full-time and the ATTORNEY IS
FULL-TIME AND THE salary is [$15,000] $34,125 $34,000. (2)
The State's Attorney's allowance for postage, office and
travel expenses is a minimum of $6,000. However, any amount
in excess of $6,000 shall be at the discretion of the Board
of County Commissioners. (3) The State's Attorney may
appoint an assistant State's attorney to ADDITIONAL
ASSISTANT STATE'S ATTORNEYS AS APPROVED BY THE BOARD OF
COUNTY COMMISSIONERS AND PROVIDED FOR IN THE GARRETT COUNTY
BUDGET. (4) THE ASSISTANT STATE'S ATTORNEYS SHALL serve at
the pleasure of the State's Attorney. The assistant State's
attorney's salary is not less than [$5,000] $11,000 $10,000
a year.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
may not be construed to extend or apply to the salary of the
Garrett County State's Attorney or the assistant State's
attorney in office on the effective date of this Act, nor
may this Act be construed to increase the Garrett County
State's Attorney's position to a full-time position, nor may
this Act be construed to provide additional assistant
State's attorneys on the effective date of this Act, but the
provisions of this Act concerning the salaries of the
Garrett County State's Attorney and the assistant State's
attorney, the appointment of additional assistant State's
attorneys, and increasing the position of the State's
Attorney to a full-time position shall take effect at the
beginning of the next following term of office of the
Garrett County State's Attorney.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
