(House Bill 76)

AN ACT concerning

Drug Formulary

FOR the purpose of deleting an obsolete provision that
requires the Department of Health and Mental Hygiene
and certain subcommittees of the medical assistance
program advisory committee meet and determine a drug
formulary; and deleting the requirement that the
Department publish a formulary determined under that
provision.

BY renumbering

Section 42(a)(5), (6), and (7), respectively

to be Section 42(a)(4), (5), and (6), respectively

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

42.

(a) [(4) The State Department of Health and Mental
Hygiene and the physicians and pharmacists services
subcommittees of the Maryland medical assistance program
advisory committee shall meet jointly to determine which
drugs shall be listed in a formulary system. After the
meetings, the Department shall publish the formulary, which
shall include those generic drugs having clinical
equivalency. The above subcommittees shall take due
recognition of studies and recommendations of the U. S.
Food and Drug Administration and shall consult with various
schools of pharmacy and any other medical and
pharmacological experts as it shall deem advisable.]

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s)
42(a)(5), (6), and (7), respectively, of Article 43 -
Health, of the Annotated Code of Maryland be renumbered to
be Section(s) 42(a)(4), (5), and (6), respectively.
