(b) The standards and qualifications adopted by the
Secretary may not require that the director of any such
laboratory be a physician licensed under [this article] THE
HEALTH OCCUPATIONS ARTICLE. Any person who was, for a period
of seven consecutive years prior to June 1, 1966, the
director of a laboratory which had met the standards and
qualifications in effect for laboratories prior to June 1,
1966, shall be considered to meet all academic and
experience requirements for a laboratory director which are
established on and after June 1, 1966; and any laboratory
which, for a similar period of seven years, had met the
standards and qualifications in effect prior to June 1,
1966, shall be issued a permit under this section, and,
thereafter shall comply with the rules and regulations
established under this section. The director of a tissue
bank must be a physician licensed to practice medicine in
Maryland.

(b) The State Board of Health, its agents or
employees, shall have the right to enter any industrial
plant, place of business or public premises at reasonable
hours in order to carry out the investigations authorized by
this section, and in addition said Board, its agents or
employees, shall have such right of entry whenever necessary
to carry out any of the duties imposed upon them by this
article OR THE HEALTH OCCUPATIONS ARTICLE. Any person
interfering with, or denying entry to the said Board, its
agents or employees, while engaged in such performance of
duties, shall be guilty of a misdemeanor and, upon
conviction, shall be fined not more than one hundred
dollars.

42.

(a) (2) (i) For this purpose, the Secretary may
contract with insurance companies, nonprofit health service
plans, or with individuals, associations, partnerships,
incorporated or unincorporated groups of physicians,
chiropractors, dentists, podiatrists, optometrists (as
defined in § [368(e) of this article)] 10-101 OF THE HEALTH
OCCUPATIONS ARTICLE), pharmacists, hospitals, nursing homes,
nurses, opticians, and other health practitioners duly
licensed or certified in this State who perform services
upon the prescription or referral of a physician, for the
provision of care for eligible persons. The contracts shall
be for a one-year period and may be renewed. Within the
provisions of the budget the Secretary is authorized to
provide for bedside nursing care for eligible persons.

42P.

The Secretary of Health and Mental Hygiene, after
consulting with the STATE Board of Pharmacy, may authorize a
licensed physician to be reimbursed for the dispensing of
drugs on the same basis as a [registered] LICENSED
pharmacist if:
