In subsection (a)(3), (4), and (5) of this
section, as to the substitution of the phrase
"with the advice of the Secretary" for "on the
recommendation of the Secretary", see the General
Revisor's Note to this article.
In subsection (a)(3) of this section, the term
"Maryland Society of Otolaryngology" is
substituted for the term "Maryland Ear, Nose and
Throat Society" to conform to the current name of
the organization.
In subsection (c)(5) of this section,
"participates" is substituted for "participated"
to conform to the uniform approach inherent in
Ch. 702, Acts of 1980, which enacted the
provisions concerning consumer representatives on
the health occupations boards governed by this
article. Also, the Department advised that the
uniform approach was intended and that the
deviation "participated" was a technical error.
Present Art. 43, § 803(b)(5)(iii), as to speech
pathology, and § 914(a)(2)(iii)3., as to
occupational therapy, contain the only 2
references out of 19 in Ch. 702, Acts of 1980, to
a household member who "participated" in a
related field. The Commission to Revise the
Annotated Code calls this substitution to the
attention of the General Assembly.
As to the continuing stagger under subsection
(f)(2) of this section, the terms of the members
serving on July 1, 1981 expire as follows: (1)
one member in 1981; (2) two members in 1982; (3)
one member in 1984; and (4) two members in 1985.
In subsection (f)(5) of this section, the phrase
"full" terms is added for clarity, to conform to
the current interpretation of this provision by
the Board.
The provision of present Art. 43, § 801(a)(1)
that exempts the original appointees to the Board
from the licensing requirement of § 19-301 of
this title is deleted as obsolete.
