(B) ACTIVITIES AND SERVICES NOT LIMITED.

THIS TITLE DOES NOT LIMIT THE RIGHT OF A HEARING AID
DEALER TO FIT AND DEAL IN HEARING AIDS.

REVISOR'S NOTE: Subsection (a)(1) of this section is
new language added to reflect more accurately the
state of the present law and to conform to the
language used in similar provisions in other
titles of this article.

Subsections (a)(2) and (b) of this section are
new language derived without substantive change
from the last sentence of Art. 43, § 792(b) and
from Art. 43, § 792(e).

In subsection (a)(2) of this section, the phrase
"authorized to practice" is substituted for
"licensed" to express the apparent intent of the
present provision by including those individuals
who are not licensed, but who otherwise are
entitled to practice their profession in this
State.

Present Art. 43, § 792(d) — which provides that
this title does not prevent a medical or
osteopathic physician from performing certain
acts related to audiology and speech pathology —
is deleted as unnecessary in light of the broad
provisions of subsection (a)(1) of this section,
which covers all health occupations licensed
under this article.

For the provisions that relate generally to
hearing aid dealers, see Art. 43, § 737 et seq.
of the Code.

SUBTITLE 2. STATE BOARD OF EXAMINERS FOR SPEECH
PATHOLOGISTS.

19-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF EXAMINERS FOR SPEECH
PATHOLOGISTS IN THE DEPARTMENT.

REVISOR'S NOTE: This section presently appears as the
first sentence of Art. 43, § 803(a).

It is set forth as a separate section for
emphasis.

The word "State" is added to the name of the
Board to achieve uniformity among the names of
the health occupation boards that this article
governs.
