18-305. WAIVER OF EXAMINATIONS.
(A) IN GENERAL.
SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
SHALL WAIVE THE EXAMINATION REQUIREMENTS OF THIS TITLE FOR
AN APPLICANT WHO IS LICENSED OR REGISTERED TO PRACTICE
SOCIAL WORK IN ANY OTHER STATE.
(B) CONDITIONS.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:
(1) PAYS THE APPLICATION FEE REQUIRED BY THE
BOARD UNDER § 18-303 OF THIS SUBTITLE; AND
(2) PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:
(I) MEETS THE QUALIFICATIONS OTHERWISE
REQUIRED BY THIS TITLE; AND
(II) BECAME LICENSED OR REGISTERED IN THE
OTHER STATE AFTER PASSING IN THAT OR ANY OTHER STATE AN
EXAMINATION THAT IS SIMILAR TO THE EXAMINATION FOR WHICH THE
APPLICANT IS SEEKING THE WAIVER.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 867.
Its revision is patterned after the standard
language used throughout this article for
provisions that allow or require waiver of
examination requirements.
In subsections (a) and (b)(2)(ii) of this
section, the phrases "any other state" and "the
other state", respectively, are substituted for
the present phrases "another jurisdiction", "a
state or territory of the United States", and
"that state or territory" in light of the
definition of "state" in § 1-101 of this article.
In subsection (b)(2)(ii) of this section, the
phrase "or any other" state is added to provide
expressly that a social worker who passed a
licensing examination in one state, and who was
then waived into a second state, then may be
waived by the Board into Maryland — a third
