article and conforms with current Board practice.

As to the authority of the Board to set fees, see
§ 15-206 of this title.

15-309. INACTIVE STATUS; REINSTATEMENT OF EXPIRED LICENSES.

(A)  INACTIVE STATUS.

(1)  THE BOARD MAY PLACE A LICENSEE ON INACTIVE
STATUS, IF THE LICENSEE SUBMITS TO THE BOARD:

(I)  AN APPLICATION FOR INACTIVE STATUS ON
THE FORM REQUIRED BY THE BOARD; AND

(II)  THE ANNUAL INACTIVE STATUS FEE SET BY
THE BOARD.

(2)  AN INDIVIDUAL ON INACTIVE STATUS LOSES THAT
STATUS AFTER 1 YEAR, UNLESS THE INDIVIDUAL EXTENDS THAT
STATUS FOR AN ADDITIONAL 1-YEAR PERIOD BY PAYING TO THE
BOARD THE ANNUAL INACTIVE STATUS FEE SET BY THE BOARD.

(3)  THE BOARD SHALL ISSUE A LICENSE TO AN
INDIVIDUAL WHO IS ON INACTIVE STATUS IF THE INDIVIDUAL
SUBMITS TO THE BOARD:

(I)  SATISFACTORY EVIDENCE OF COMPLIANCE
WITH THE CONTINUING EDUCATION REQUIREMENTS THE BOARD ADOPTS
FOR THIS PURPOSE; AND

(II)  A REINSTATEMENT FEE, SET BY THE
BOARD, OF NOT MORE THAN $50.

(B)  REINSTATEMENT OF EXPIRED LICENSES.

THE BOARD SHALL REINSTATE THE LICENSE OF A PODIATRIST
WHO HAS NOT BEEN PUT ON INACTIVE STATUS AND WHO HAS FAILED
TO RENEW THE LICENSE FOR ANY REASON, IF THE PODIATRIST:

(1)  MEETS THE RENEWAL REQUIREMENTS OF § 15-308
OF THIS SUBTITLE; AND

(2)  PAYS TO THE BOARD ALL PAST-DUE RENEWAL FEES
AND THE REINSTATEMENT FEE SET BY THE BOARD.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 43, § 493(b)(2) and from Art.
43, § 493(b)(3).

In subsection (a)(l)(i) of this section, new
language is added to state expressly a provision
that presently is only implied in the law —
i.e., that applications be made only on the form
required by the Board.
