broad rulemaking powers — to set reasonable fees
for its services. Although present Art. 43, §
493(a) refers only to the establishment of fees
for "examinations, reexaminations and
certificates and an annual license fee", its
provisions should not be read to preclude the
imposition of fees in other instances, as
appropriate. See, e.g.: present Art. 43, §
493(b), which refers to renewal fees, late fees,
reinstatement fees, and inactive status fees;
present Art. 43, § 487(a), which refers to
application fees; and present Art. 43, § 488(a),
which refers to limited license fees.
Also in subsection (a) of this section, the
introductory phrase of present Art. 43, §
493(a), which refers to providing "a fund in
order to carry out and enforce the provisions of
this subtitle", is revised to require that fees
charged by the Board "be set so as to produce
funds to approximate the cost of maintaining the
Board", since all funds collected by the Board
become part of the General Fund of this State
under present Art. 43, § 493(c) — now subsection
(b) of this section.
As to subsection (b) of this section, the third
sentence of present Art. 43, § 493(c), which
requires that disbursement of funds be in
accordance with Art. III, §§ 32 and 52 of the
State Constitution and Art. 15A, §§1 through 15
of the Code, which relate to disbursements from
the General Fund of this State, is deleted as
implicit in the requirement that the funds are
part of the General Fund of this State.
SUBTITLE 3. LICENSING.
15-301. LICENSE REQUIRED; EXCEPTIONS.
EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, AN
INDIVIDUAL SHALL BE LICENSED BY THE BOARD BEFORE THE
INDIVIDUAL MAY PRACTICE PODIATRY IN THIS STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
481(a).
This section is rephrased in the standard
language used throughout this article to state
affirmatively that an individual must be licensed
to practice a health occupation in this State.
