14-801. SHORT TITLE.

THIS TITLE MAY BE CITED AS THE "MARYLAND MEDICAL
PRACTICE ACT".

REVISOR'S NOTE: This section is new language added to
conform to similar sections in other titles of
this article and to provide a convenient
reference to this title.

Note that the caption to this title is
"Physicians" but the short title is the "Maryland
Medical Practice Act", since the latter title
reflects the most commonly accepted reference in
the profession.

14-802. TERMINATION OF TITLE.

SUBJECT TO THE EVALUATION AND REESTABLISHMENT
PROVISIONS OF THE REGULATORY PROGRAMS EVALUATION ACT OF
1978, THIS TITLE AND ALL RULES AND REGULATIONS ADOPTED UNDER
THIS TITLE SHALL TERMINATE AND BE OF NO EFFECT AFTER JULY 1,
1983.

REVISOR'S NOTE: This section is new language derived in
part from Art. 43, § 136D.

Present Art. 43, § 136D appears on its face to
provide that only present Art. 43, §§ 120 through
128 will be of no effect after a particular date,
thus leaving present Art. 43, §§ 119 and 129,
130, 130A, 134, 134A, 136(a), except items (1)
and (4), 136A, and 136C in full force. However,
in practice, if present Art. 43, §§ 120 through
128 were repealed, some of the remaining sections
would be unable to stand on their own. In
addition, an anomalous situation would exist,
there would remain a disciplining agency, i.e.,
the Commission on Medical Discipline, out the
licensing board would no longer exist. In
effect, there would be no licensed physicians to
discipline. To avoid this potential source of
confusion, the Commission to Revise the Annotated
Code has revised this section to state expressly
what the present law only implies — i.e., this
entire title is covered by the scope of this
section.

As to the Regulatory Programs Evaluation Act of
1978, see Art. 41, § 484 et seq. of the Code.

GENERAL REVISOR'S NOTE:

The present provisions of Art. 43 that govern the
practice of medicine provide that before a physician may
practice in this State, the physician must be both licensed
and registered. The statutes then provide for periodic
