128(c) and the first clause of (d), and from Art.
43, § 128(e).
Subsection (b) of this section — which provides
for renewal notice -- is new language added to
conform to current Board practice and to similar
provisions governing other health occupations in
present Art. 43. See, e.g., Art. 43, § 634(c),
as to psychologists, and Art. 43, § 868(d), as to
social workers.
Subsection (c)(1) of this section is standard
language added for clarity.
Subsection (c)(2) and (3) of this section is
added to clarify the authority of the Board under
§ 14-205 of this title and subsection (d) of this
section to adopt standards and qualifications for
continued licensing and under § 14-206 of this
title to establish fees for renewal of licenses.
Subsection (e) of this section is standard
language added to state expressly the presently
only implied duty of the Board to renew the
license of a qualified licensee.
The present references to "registration" are
deleted and the term "license renewal" is
substituted for the term "reregistration". These
changes conform with changes in terminology made
throughout this title. See the General Revisor's
Note to this title.
In subsection (a)(3) of this section, the first
clause of present Art. 43, § 128(d), which
provides that failure to register "shall cause a
suspension" is deleted as misleading and, in any
event, unnecessary. Under this section, if a
licensee fails to renew a license, it "expires"
automatically at the end of the current license
term. See present Art. 43, § 122(a), now revised
as § 14-701 of this title, and the General
Revisor's Note to this title.
In subsection (d) of this section, the
introductory clause is added in light of the
power of the Board to establish other
qualifications and requirements under § 14-305(f)
of this subtitle.
The second sentence of present Art. 43, § 128(a)
and present Art. 43, § 128(b), which relate to
the Board keeping a permanent record of licensed
physicians now appear as § 14-205(b)(2) of this
title.
