"COUNTY" MEANS A COUNTY OF THIS STATE AND, UNLESS
EXPRESSLY PROVIDED OTHERWISE, BALTIMORE CITY.

REVISOR'S NOTE: This subsection is new language added
to indicate that a reference in this article to
"county" includes Baltimore City, unless the
reference specifically provides otherwise.

Art. 1, § 14 of the Code provides that "county"
includes Baltimore City "unless such construction
would be unreasonable". However, the word
"unreasonable" in that section has been
interpreted various ways. Therefore, the
Commission to Revise the Annotated Code concluded
that a more explicit definition of "county"
should be included here.

(D)  DEPARTMENT.

"DEPARTMENT" MEANS THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE.

REVISOR'S NOTE: This subsection is new language added
to avoid repetition of the full title "Department
of Health and Mental Hygiene".

(E)  HOUSEHOLD MEMBER.

"HOUSEHOLD MEMBER" MEANS SOMEONE WHO IS THE
INDIVIDUAL'S RELATIVE, BY BLOOD OR MARRIAGE, OR WARD, AND:

(1)  WHO SHARES THE INDIVIDUAL'S LEGAL RESIDENCE;
OR

(2)  WHOSE FINANCIAL AFFAIRS ARE UNDER THE LEGAL
OR ACTUAL CONTROL OF THE INDIVIDUAL.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from Art. 43, §
119(j).

The enumeration of types of relatives is deleted
as unnecessary in light of the broader term
"relative".

The phrase "by blood or marriage" is added to
clarify the broad scope of the term "relative".

Definitions of "household member" identical to
present Art. 43, § 119(j) appear in present Art.
32, § 2B(a)(2) and present Art. 43, §§ 257(b)(2),
291(f), 340(a)(2), 368(h), 467(b)(2), 492(f),
499(d)(2), 555B-l(m), 605(f), 619(e), 725(8),
767(6), 791(10), 860(g), and 911(1). These
definitions are deleted in the appropriate titles
as unnecessary in light of this subsection.
