(2) THE BOARD MAY NOT REQUIRE THE PHYSICAL
THERAPIST OR PHYSICAL THERAPIST ASSISTANT WHO QUALIFIES FOR
REINSTATEMENT UNDER THIS SUBSECTION TO BE REEXAMINED UNDER §
13-306 OF THIS SUBTITLE.
(B) REINSTATEMENT — NOT PERMITTED.
THE PHYSICAL THERAPIST OR PHYSICAL THERAPIST ASSISTANT
WHO DOES NOT QUALIFY UNDER SUBSECTION (A) OF THIS SECTION
MAY NOT HAVE THE LICENSE REINSTATED. THE PHYSICAL THERAPIST
OR PHYSICAL THERAPIST ASSISTANT MAY BECOME LICENSED ONLY BY
MEETING THE CURRENT REQUIREMENTS FOR OBTAINING A NEW LICENSE
UNDER THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
611A(c) and (d).
In subsection (a)(l)(iii) of this section, the
requirement that the individual "{o}therwise
{be} entitled to be licensed" is substituted
for the requirement that the individual has not
violated "any other provision of this subtitle",
for clarity, as the prohibited acts in this title
are contained only in Subtitle 4, "Prohibited
Acts; penalty", of this title.
Subsection (a)(2) of this section is new language
added to state expressly what presently is only
implied in the law — i.e., that a physical
therapist or physical therapist assistant
qualifying for reinstatement under subsection (a)
of this section need not take the examination
given under § 13-306 of this subtitle.
Subsection (b) of this section, which is derived
from present Art. 43, § 611A(c)(2), is revised to
clarify that an applicant who does not qualify
for reinstatement under subsection (a) of this
section, must comply with all initial licensing
requirements.
13-313. TEMPORARY LICENSE.
(A) AUTHORITY TO ISSUE.
(1) SUBJECT TO THE PROVISIONS OF THIS SECTION,
THE BOARD SHALL ISSUE A TEMPORARY LICENSE TO AN APPLICANT
WHO:
(I) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF
THIS SUBSECTION AND EXCEPT FOR THE EXAMINATION REQUIREMENTS
OF THIS SUBTITLE, HAS MET THE APPROPRIATE LICENSING
REQUIREMENTS OF THIS TITLE TO THE SATISFACTION OF THE BOARD;
(II) SUBMITS TO THE BOARD:
