Subsection (b) of this section — which provides
for renewal notice — is new language added to
conform to current Board practice and to similar
provisions governing other health occupations in
present Art. 43. See, e.g., Art. 43, § 634(c),
as to psychologists, and Art. 43, § 868(d), as to
social workers.

Subsection (d) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to state expressly the presently implied
duty of the Board to issue a license renewal to a
qualified applicant.

Present Art. 43, § 611A(e) — which states that
this section and § 13-312 of this subtitle do not
apply to a "temporary permit", now revised as a
"restricted license" — is deleted as unnecessary
in light of the independent provision on renewal
of a restricted license in § 13-314 of this
subtitle.

As to the renewal of a temporary license, see §
13-313 of this subtitle.

As to the authority of the Board to set fees, see
§ 13-207 of this title.

13-312. REINSTATEMENT OF EXPIRED LICENSES.

(A) REINSTATEMENT -- PERMITTED.

(1) IF THE FORMER HOLDER OF A PHYSICAL THERAPY
LICENSE OR PHYSICAL THERAPIST ASSISTANT LICENSE FAILS FOR
ANY REASON TO RENEW THE LICENSE WITHIN 3 YEARS AFTER IT HAS
EXPIRED, THE BOARD SHALL REINSTATE THE APPROPRIATE LICENSE,
IF THE PHYSICAL THERAPIST OR PHYSICAL THERAPIST ASSISTANT:

(I)  WAS LICENSED BY PASSING THE
EXAMINATION OF THE PROFESSIONAL EXAMINATION SERVICE;

(II)  HAS NOT PRACTICED ACTIVELY PHYSICAL
THERAPY OR LIMITED PHYSICAL THERAPY IN THIS STATE DURING
THAT PERIOD;

(III)  OTHERWISE IS ENTITLED TO BE
LICENSED;

(IV)  PAYS TO THE BOARD THE APPLICATION FEE
SET BY THE BOARD; AND

(V) SUBMITS TO THE BOARD AN APPLICATION ON
THE FORM REQUIRED BY THE BOARD.
