other state", respectively, are substituted for
the phrase "any other state, Commonwealth,
possession of the United States, or the District
of Columbia" in light of the definition of
"state" in § 1-101 of this article.
In subsection (b)(2)(ii) of this section, the
phrase "or any other" state is added to provide
expressly that a physical therapist or physical
therapist assistant who passed a licensing
examination in one state, and who was then waived
into a second state, then may be waived by the
Board into Maryland — a third state — on the
basis of the license in the second state, which
was acquired by waiver on the basis of being
examined and licensed in the first state. This
provision, which is included in most of the
titles of this article, allows the Board to give
fair consideration under this section to a
physical therapist or physical therapist
assistant who, in the course of that professional
career, has moved from one state to another
before moving to Maryland to practice here.
Also in subsection (b)(2)(ii) of this section,
the phrase "an examination that is similar to the
examination" in this State is new language added
to state expressly that which presently is only
implied in the law — i.e., that an applicant for
an examination waiver under this section must
have passed an examination that is similar to the
examination for which the applicant is seeking
the waiver.
13-308. ISSUANCE OF LICENSE.
THE BOARD SHALL ISSUE THE APPROPRIATE LICENSE TO AN
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS TITLE FOR THAT
LICENSE.

13-309. SCOPE OF PHYSICAL THERAPY LICENSE.
A PHYSICAL THERAPY LICENSE AUTHORIZES THE LICENSEE TO
PRACTICE PHYSICAL THERAPY WHILE THE LICENSE IS EFFECTIVE.

for clarity to this and, where necessary, other
subtitles of this title.
