In subsection (c)(2)(i) of this section, the
reference to a daily newspaper "of general
circulation in this State" is substituted for the
reference to a newspaper "published in the City
of Baltimore" to express the apparent intent of
the law to give widespread notice. For a similar
revision, see § 7-304(c)(1)(i) of this article.
This substitution is called to the attention of
the General Assembly.
13-307. WAIVER OF EXAMINATIONS.
(A) IN GENERAL.
SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
MAY WAIVE ANY EXAMINATION REQUIREMENT OF THIS TITLE FOR AN
APPLICANT WHO IS LICENSED OR OTHERWISE IS AUTHORIZED TO
PRACTICE PHYSICAL THERAPY OR LIMITED PHYSICAL THERAPY IN
ANOTHER STATE.
(B) CONDITIONS.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:
(1) PAYS THE APPLICATION FEE SET BY THE BOARD
UNDER § 13-305 OF THIS SUBTITLE; AND
(2) PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:
(I) MEETS THE QUALIFICATIONS OTHERWISE
REQUIRED BY THIS TITLE; AND
(II) BECAME LICENSED OR OTHERWISE
AUTHORIZED IN THE OTHER STATE AFTER PASSING IN THAT OR ANY
OTHER STATE AN EXAMINATION THAT IS SIMILAR TO THE
EXAMINATION FOR WHICH THE APPLICANT IS SEEKING THE WAIVER.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
610(b). Its revision is patterned after the
standard language used throughout this article
for provisions that allow or require waiver of
examination requirements.
In subsections (a) and (b)(2)(ii) of this
section, the broader phrase "or otherwise
authorized" is substituted for the present term
"registered" to clarify that the Board may waive
the examination requirement for an applicant who
in any way is authorized to practice physical
therapy or limited physical therapy in another
state.
