storage of drugs and devices is not a function
reserved to practicing pharmacy, the storage
provision is not retained as an element of the
definition of "practice pharmacy" in § 12-101 of
this title. Instead, it is revised in this
section, in accordance with the apparent
legislative intent, as an affirmative requirement
that all drugs, medicines, and devices held by a
pharmacy be stored in a proper and safe manner.
A qualification that proper and safe storage may
be subject to the rules and regulations of the
Board also is added to coordinate with the
Board's rulemaking power under § 12-205 of this
title.

The reference to "medicines" is added in
conformity with the usual trilogy of "drugs,
medicines, and devices" used throughout this
title. See the General Revisor's Note to this
title.

12-507. DATING OF PRESCRIPTION BY AUTHORIZED PRESCRIBER;
TIME LIMIT FOR FILLING PRESCRIPTION.

(A)  AUTHORIZED PRESCRIBER REQUIRED TO SPECIFY DATE OF
PRESCRIPTION.

AN AUTHORIZED PRESCRIBER WHO ISSUES A PRESCRIPTION
SHALL INDICATE ON THE PRESCRIPTION THE DATE OF ITS ISSUANCE.

(B)  TIME LIMIT FOR FILLING PRESCRIPTION.

UNLESS OTHERWISE INSTRUCTED BY THE AUTHORIZED
PRESCRIBER WHO ISSUES THE PRESCRIPTION, A PHARMACIST MAY NOT
DISPENSE ANY DRUG, MEDICINE, OR DEVICE ON A PRESCRIPTION
PRESENTED MORE THAN 120 DAYS AFTER THE DATE THE PRESCRIPTION
WAS ISSUED.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first two
sentences of Art. 43, § 254B.

In this section and throughout this title, the
term "authorized prescriber" — which is defined
in § 12-101 of the title — is substituted for
the present, unnecessarily diverse references to
those who may issue a prescription. While the
substituted term is broader than the present
reference, it is consistent with the apparent
intent behind the present provision. See also
the General Revisor's Note to this title.

In subsection (b) of this section, the words
"drug" and "device" are added in conformity with
the usual trilogy of "drugs, medicines, and
devices" used throughout this title. See the
General Revisor's Note to this title.
