12-505. REQUIRED RECORDS.
(A) RECORDS OF PRESCRIPTIONS.
IN EACH PHARMACY, A RECORD OF EACH PRESCRIPTION
PREPARED OR DISPENSED IN THE PHARMACY SHALL BE MADE AND KEPT
ON FILE FOR AT LEAST 5 YEARS.
(B) OTHER RECORDS REQUIRED.
IN EACH PHARMACY, ADDITIONAL RECORDS ALSO SHALL BE KEPT
AS REQUIRED BY THE RULES AND REGULATIONS ADOPTED BY THE
BOARD.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
250(a)(3) and the first half of the first
sentence of § 254.
Art. 43, § 250(a)(3) presently appears as part of
the definition of "practice of pharmacy". Since
keeping records is not a function reserved to
practicing pharmacy it is revised in this
section, in accordance with the apparent
legislative intent, as an affirmative requirement
that records be kept as required by the rules and
regulations adopted by the Board.
In subsection (a) of this section, the reference
to prescriptions "prepared or dispensed" is
substituted for the present reference to
prescriptions "compounded or dispensed" to
conform with the terminology used in the
definition of "practice pharmacy" in § 12-101 of
this title.
As to the power of the Board to adopt rules and
regulations, see § 12-205 of this title.
The second half of the first sentence of Art. 43,
§ 254, which provides for the inspection of the
required records, now appears in § 12-511 of this
subtitle.
12-506. STORAGE OF DRUGS, MEDICINES, AND DEVICES.
SUBJECT TO THE RULES AND REGULATIONS ADOPTED BY THE
BOARD, ALL DRUGS, MEDICINES, AND DEVICES HELD BY A PHARMACY
SHALL BE STORED PROPERLY AND SAFELY.
