12-303. APPLICATIONS FOR LICENSES.
(A) IN GENERAL.
TO APPLY FOR A LICENSE, AN APPLICANT SHALL:
(1) SUBMIT AN APPLICATION TO THE BOARD ON THE
FORM THAT THE BOARD REQUIRES; AND
(2) PAY TO THE BOARD AN APPLICATION FEE OF $40.
(B) VERIFICATION.
AN APPLICATION SHALL BE SIGNED AND VERIFIED BY THE
APPLICANT AS TO COMPLETION OF THE REQUIRED CLINICAL
TRAINING.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 43, § 261(a) and from Art. 43, §
263.
In subsection (a)(1) of this section, the
reference to the application being submitted on
the form required by the Board is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to state expressly a requirement that
presently is only implied in the law.
The present ambiguous requirement in the first
sentence of Art. 43, § 261(a) that an applicant
shall apply "at least ten days before any stated
meeting of the Board" (emphasis added) is
deleted. If the 10-day provision is meant to
apply literally to any meeting of the Board, it
is impractical because there is no functional
relationship between a routine meeting of the
Board and the submission of an application. If,
on the other hand, the referenced "meeting" is
intended to mean only the time during which an
examination actually is given, the provision is
both impractical and inconsistent with the
requirement of present Art. 43, § 258(b) — now §
12-304 of this subtitle — for giving notice of
examination.
