(F)  TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 5 YEARS, EXCEPT THAT
THE INITIAL TERM OF THE CONSUMER MEMBER APPOINTED ON JULY 1,
1980 SHALL BE 4 YEARS.

(2)  THE TERMS OF MEMBERS ARE STAGGERED AS
REQUIRED BY THE TERMS PROVIDED FOR MEMBERS OF THE BOARD ON
JULY 1, 1981.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(G)  REMOVAL.

THE GOVERNOR MAY REMOVE A MEMBER FOR INCOMPETENCE OR
MISCONDUCT.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
257(c), (d), and (e) — except for item (v) of
that subsection, which now appears in § 12-304 of
this title -- and from Art. 43, § 257(f).

Subsection (g) of this section is new language
derived without substantive change from Art. II,
§ 15 of the State Constitution. For other
provisions on removal, see: Art. XV, § 2 of the
State Constitution, on suspension and removal for
crimes; and Art. 41, § 4 of the Code, on removal
for failure to attend meetings.

In this section and throughout this title, the
term "member" is substituted for the present term
"Commissioner" to conform with the terminology
used throughout this article.

In subsection (a)(3) and (4) of this section, as
to the substitution of "advice of the Secretary"
for "recommendation of the Secretary", see the
General Revisor's Note to this article.

In subsection (a)(6) of this section, the present
term "instructor" is deleted as included within
the broader term "teacher".

In subsection (b)(2) of this section, the
reference to the prescriptions of "authorized
prescribers" is substituted for the reference to
"physicians". Although the substituted language
is broader than the present reference, it
reflects the apparent intent behind the present
provision. See the General Revisor's Note to
this title.
