REVISOR'S NOTE: This section is new language derived
without substantive change from the first two
clauses of Art. 43, § 480(f).

The penalty provision of present Art. 43, §
480(f) now appears in § 11-407 of this subtitle.

The term "false name" is substituted for the
references to types of false names.

11-404. FALSE DIPLOMA REPRESENTATION.

AN APPLICANT FOR A LICENSE MAY NOT REPRESENT FALSELY
THAT THE APPLICANT HOLDS A DIPLOMA OR DEGREE FROM A COLLEGE
OR UNIVERSITY ACCREDITED BY THE AMERICAN OSTEOPATHIC
ASSOCIATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 479,
as that section relates to an applicant falsely
representing that the applicant holds a diploma.

The reference to the school being accredited by
the American Osteopathic Association is new
language added to conform to the education
qualifications of § 11-302 of this title.

The penalty provisions of present Art. 43, § 479
now appear in § 11-407 of this subtitle.

11-407. PENALTY.

(A)  IN GENERAL.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, A
PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS GUILTY
OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $500 OR IMPRISONMENT IN JAIL NOT EXCEEDING 90 DAYS
OR BOTH.

(B)  EXCEPTION.

A PERSON WHO VIOLATES THE PROVISIONS OF § 11-403 OF
THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
IS SUBJECT TO A FINE NOT EXCEEDING $500 OR IMPRISONMENT IN
JAIL NOT EXCEEDING 1 YEAR OR BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from the penalty
provisions of Art.43, §§ 479 and 480(f).

The present minimum penalties are deleted to
conform to the statement of legislative policy
