(1) EXCEPT AS PROVIDED IN THIS SUBSECTION,
UNLESS AUTHORIZED TO PRACTICE UNDER THIS TITLE, A PERSON MAY
NOT USE THE WORDS OR TERMS "OSTEOPATH", "OSTEOPATHIST",
"OSTEOPATHY", "DOCTOR OF OSTEOPATHY", "DIPLOMATE IN
OSTEOPATHY", OR "D.O." WITH THE INTENT TO REPRESENT THAT THE
PERSON PRACTICES OSTEOPATHY.
(2) A HOLDER OF A DEGREE OF OSTEOPATHY WHO IS
AUTHORIZED TO PRACTICE MEDICINE IN THIS STATE MAY USE THE
DEGREE OR AN ABBREVIATION FOR THE DEGREE IN CONNECTION WITH
THE NAME OF THE HOLDER.
REVISOR'S NOTE: This section is derived in part from
Art. 43, § 479 — as that section relates to the
use of certain names or titles, and revised in
the standard language used throughout this
article to express a prohibition against false
representations of authority to practice a health
occupation.
Subsection (b)(1) of this section is derived from
those specific elements of present Art. 43, § 479
that are not covered clearly by the general
language of subsection (a) of this section.
In subsection (b)(1) of this section, the present
reference to practicing osteopathy under the name
chiropractic, neuropathy, mechanotherapy, and
naprapathy is deleted as obsolete and, in any
event, unnecessary in light of the broader
general provisions of this section.
Subsection (b)(2) of this section is new language
added to recognize that the State Board of
Medical Examiners may authorize the holder of a
degree of osteopathy to practice medicine. See
present Art. 43, §§ 123 and 124.
The penalty provisions in present Art. 43, § 479
now appear in § 11-407 of this subtitle.
The General Assembly may wish to consider the
addition of subsection (b)(2) of this section to
this title. The provision is added to this title
to avoid the anomalous situation that occurs if a
holder of a degree of doctor of osteopathy is
licensed as a physician and uses the degree in
connection with the holder's name but is not
licensed under this title and, therefore, is not
authorized to use certain terms.
11-403. PRACTICING UNDER A FALSE NAME.
A PERSON MAY NOT PRACTICE OR ATTEMPT TO PRACTICE
OSTEOPATHY UNDER A FALSE NAME.
