The eighth sentence of present Art. 43, § 471,
which relates to keeping a record of Board
proceedings, now appears in § 11-205 of this
title.

11-305. WAIVER OF EXAMINATIONS.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
SHALL WAIVE THE EXAMINATION REQUIREMENTS OF THIS TITLE FOR
AN INDIVIDUAL WHO IS LICENSED TO PRACTICE OSTEOPATHY IN ANY
OTHER STATE.

(B)  CONDITIONS.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:

(1)  IS OF GOOD MORAL CHARACTER;

(2)  PAYS AN APPLICATION FEE REQUIRED BY § 11-303
OF THIS SUBTITLE; AND

(3)  PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:

(I)  IS LICENSED IN THE OTHER STATE; AND

(II)  BECAME LICENSED IN THE OTHER STATE
UNDER REQUIREMENTS SUBSTANTIALLY EQUIVALENT TO THE
REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
476(a). Its revision is patterned after the
standard language used throughout this article
for provisions that allow or require waiver of
examination requirements.

Subsection (b)(1) of this section is new language
added to clarify that the Board has the power to
deny a license to an applicant who, at the time
of application, is not of good moral character.

In subsection (b)(3) of this section, the phrase
"provides adequate evidence" is substituted for
the archaic reference to "certified by the
affidavit of the president or secretary of such
board".

Subsection (b)(3)(ii) of this section is revised
to reflect the Board practice of requiring an
applicant who seeks a waiver of the examination
to meet the present Board standards for
licensing.
