Rescue Commission certain responsibilities previously
exercised by the personnel and executive committees of the
Fire Board, and making certain technical changes; by
repealing Section 21-4 and replacing it with new Sections
21-4A through 21-4V as follows: 21-4A is a statement of
policy containing legislative intent, purpose of the
Chapter, and definitions applicable to Chapter 21; 21-4B
establishes a seven-member Fire and Rescue Commission and
describes the manner of appointment or election of its
members, selection of chairperson, terms, compensation,
responsibilities, and authority, appointment of committees,
annual report, budget and staff support, enforcement,
adoption of by-laws, time requirements for certain actions,
and automatic termination; 21-4C establishes a Fire Board
and describes its composition, the manner of election of its
members, its responsibilities and authority, and its budget
and staff support; 21-4D authorizes the eighteen existing
independent fire departments and rescue squad corporations
to perform certain public safety functions; 21-4E mandates
the Fire and Rescue Commission to adopt an integrated
emergency command structure for the fire and rescue
corporations with provisions for the Director to adopt such
command structure if the Commission fails to act within a
specified time; 21-4F authorizes the Fire and Rescue
Commission to modify or improve the existing disaster plan,
subject to the approval by the Chief Administrative Officer;
21-4G mandates the Fire and Rescue Commission to establish
response areas for all fire and rescue corporations with
provisions for adoption by the Director if the Commission
fails to act within a specified time; 21-4H mandates the
Fire and Rescue Commission to establish communications and
dispatch procedures and provides for their adoption by the
Director if the Commission fails to act within a specified
time; 21-4 I mandates the Fire and Rescue Commission to
adopt a master fire defense, rescue, and emergency medical
services plan to be reviewed by the County Executive and
approved by the County Council, and provides that the County
Executive shall be responsible for development of such plan
if the Commission fails to act within a specified time;
21-4J authorizes adoption of provisions for long and short
term transfer of apparatus and, in the absence of such
provisions, authorizes the County Executive to transfer, on
an emergency basis, apparatus purchased in whole or in part
with tax funds, for a period not to exceed seven days unless
approved by the Commission; 21-4K authorizes the County
Executive to assume command of any corporation in a public
emergency; 21-4L authorizes the County in certain instances
to audit performances of any corporation supported with tax
funds; 21-4M provides for personnel services, makes the
comprehensive County Personnel Regulations applicable to
career personnel employed by local corporations and paid
from tax funds under certain circumstances unless modified
by the Commission under certain circumstances, establishes
a process for review of personnel transactions, requires
adoption of procedures concerning disclosure of illegal and
improper actions and protection from retaliatory action,
provides certain grievance procedures, provides for certain
disciplinary appeals, states that employees of local
