CHARTER AMENDMENT
RESOLUTION NO. 76
RESOLUTION of the Mayor and City Council of Cumberland,
Maryland, adopted pursuant to the authority contained in
Article 11-E of the Constitution of the State of Maryland
and Section 12 of Article 23A of the Annotated Code of
Maryland, entitled "Municipal Corporations", as said Section
was enacted by Chapter 423 of the Acts of the General
Assembly of Maryland, 1955, entitled "A RESOLUTION TO AMEND
THE CHARTER OF THE CITY OF CUMBERLAND, MARYLAND, (1966
Edition), BY REPEALING SECTION 53 OF SAID CHARTER.
WHEREAS, the City of Cumberland Police Pension Fund and
the Police Pension Fund Board were established and created
by Charter Amendment Resolution No. 37, adopted by the Mayor
and City Council of Cumberland on July 1, 1968; and
WHEREAS, the amendments thereto were made by Charter
Amendment Resolution No. 38 adopted by Mayor and City
Council of Cumberland on August 26, 1968; and
WHEREAS, said Pension Fund was created for the benefit
of the uniformed officers of the City of Cumberland Police
Department; and
WHEREAS, the Police Pension Fund Board was created to
administer said Pension Fund; and
WHEREAS, all of said officers have now become
participants in the Maryland Employees Retirement System
thereby obviating the need for the Police Pension Fund;
[Section 53 of the Charter of Cumberland, Allegany
County, repealed.
