As to subsection (b)(2)(ii) of this section, the
intended meaning of the phrase "accredited or
approved educational program" is not clear. The
issue is called to the attention of the General
Assembly.

Subsection (b)(2)(ii)2. of this section is new
language added to allow a student in an
occupational therapy assistant program or its
equivalent to have the same license exception as
a student in an occupational therapy program.
This addition is called to the attention of the
General Assembly.

In subsection (b)(3)(i) of this section,
"licensed occupational therapist" is substituted
for "occupational therapist" to conform with the
apparent intent of present Art. 43, § 911(h).
See the revisor's note to § 9-101(f) of this
title.

In subsection (b)(3)(ii) of this section, the
phrase "only support activities" is substituted
for the present, confusing phrase "whose
activities require an understanding of
occupational therapy" to clarify the types of
activities permitted to an occupational therapy
aide.

As to subsection (b)(4) and (5) of this section,
the phrases "authorized to practice occupational
therapy in any other state" and "authorized to
practice limited occupational therapy in any
other state" are added to correct an omission in
present Art. 43, § 919(b)(4).

Also in subsection (b)(4)(ii) and (5)(ii) of this
section, the phrases "notifies the Board before
practicing occupational therapy in this State"
and "notifies the Board before practicing limited
occupational therapy in this State" are
substituted for "upon prompt notification to the
Board" to clarify the timing intended.

As to subsection (b)(4)(ii) of this section, the
word "and" is substituted for "or" in the second
sentence of present Art. 43, § 919(b)(4) to
parallel the language used in the third sentence
of present Art. 43, § 919(b)(4), which describes
the requirements for an out-of-state occupational
therapy assistant to practice in this State.

of this title.
