(2) RELEASE A MORTGAGE WHEN PAID; OR
(3) ACCOMPLISH A FORECLOSURE.

(A) ANY PERSON WHO KNOWINGLY MAKES OR CAUSES TO BE
MADE ANY FALSE STATEMENT OR REPORT FOR THE PURPOSE OF
INFLUENCING THE ACTION OF THE SECRETARY ON ANY APPLICATION
FOR A LOAN OR ANY ACTION OF THE SECRETARY AFFECTING A LOAN
ALREADY MADE, IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
IS SUBJECT TO A FINE NOT EXCEEDING $5,000 OR IMPRISONMENT
NOT EXCEEDING 2 YEARS OR BOTH.
(B) ANY MORTGAGOR KNOWINGLY MAKING OR CAUSING TO BE
MADE A FALSE STATEMENT OR REPORT, AT THE OPTION OF THE
SECRETARY, AND WITHOUT REGARD TO THE COMMENCEMENT OR STATUS
OF CRIMINAL PROSECUTION, SHALL BE SUBJECT TO IMMEDIATE
ACCELERATION OF THE MORTGAGE ON WHICH HE IS LIABLE.
(C) THE CRIMINAL PENALTIES AND ACCELERATION PROVIDED
BY THIS SECTION APPLY TO ANY MATERIAL MISSTATEMENT OF FACT,
WHETHER IN THE NATURE OF AN UNDERSTATEMENT OR OVERSTATEMENT
OF FINANCIAL CONDITION, OR ANY OTHER FACT MATERIAL TO ACTION
OF THE SECRETARY.
SECTION 2. AND BE IT FURTHER ENACTED, That if the
Maryland Energy Supply and Conservation Authority is created
by law, all powers, duties, obligations, and functions given
under this Act to the Department of Economic and Community
Development and the Secretary of that Department shall be
transferred to the Maryland Energy Supply and Conservation
Authority.
SECTION 3. AND BE IT FURTHER ENACTED, That if the
Maryland Energy Supply and Conservation Authority is created
by law, all powers, duties, obligations, and functions given
under this Act to the Department of Economic and Community
Development and the Secretary of that Department shall be
transferred to the Maryland Energy Supply and Conservation
Authority.
SECTION 3 2. 3. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1981 contingent upon the
taking effect of Chapter ____ of the Acts of 1981 (H.B. ____)
(llr0955) and if Chapter ____ does not become effective, .
However, if Chapter ____ of the Acts of 1981 (S.B. 832
(llr2291) or H.B. 1264 (llr2292)), concerning the Maryland
Energy Supply and Conservation Authority, contingent upon
the taking effect of S.B. 345 or H.B. 655 of 1981 and, if
neither bill becomes effective, this Act shall be null and
void without the necessity of further action by the General
Assembly.
