LAWS OF MARYLAND

Ch.8

THIS TITLE DOES NOT LIMIT THE RIGHT OF AN INDIVIDUAL TO
PRACTICE A HEALTH OCCUPATION THAT THE INDIVIDUAL IS
AUTHORIZED TO PRACTICE UNDER THIS ARTICLE.

(B) ORTHOTISTS AND PROSTHETISTS.

THIS TITLE DOES NOT LIMIT THE PRACTICE, SERVICES, OR
ACTIVITIES OF AN ORTHOTIST OR A PROSTHETIST IN FITTING,
MAKING, OR APPLYING SPLINTS OR OTHER ORTHOTIC DEVICES, IF
THAT INDIVIDUAL IS WORKING WITHIN THE STANDARDS AND ETHICS
OF THE INDIVIDUAL'S OCCUPATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
912(a) and (c).

In subsection (a) of this section, more general
language is substituted for the present
enumerated list of health occupations to reflect
more accurately the state of the present law and
to conform with the language used in similar
provisions in other titles of this article.

As to subsection (a) of this section, the present
phrase "while practicing within the scope of
their respective licensure acts" is deleted as
unnecessary because an individual clearly is not
authorized to practice beyond the scope of the
individual's authorization.

The provisions of present Art. 43, § 912 that
relate to holding oneself out as practicing
occupational therapy are deleted as repetitive of
§ 9-402 of this title.

Present Art. 43, § 912(b), which relates to the
practice of physical therapy by authorized
individuals, is deleted as unnecessary in light
of subsection (a) of this section.

SUBTITLE 2. STATE BOARD OF OCCUPATIONAL THERAPY PRACTICE.

9-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF OCCUPATIONAL THERAPY PRACTICE
IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 913.

The word "State" is added to achieve uniformity
among the names of the health occupation boards
that this article governs.

9-202. BOARD MEMBERSHIP.
