3454                                                VETOES

Subject to Title 12 of the Real Property Article and
Ch. 608, Acts of 1976, the Authority may condemn property
for any transportation facilities project authorized to be
financed with revenue bonds of prior issues. THE AUTHORITY
MAY CONDEMN PROPERTY FOR THE EMMITSBURG PIKE TRANSPORTATION
FACILITIES PROJECT.

4-405.

(A)  THE MARYLAND TRANSPORTATION AUTHORITY SHALL
RECONSTRUCT, IMPROVE AND MAINTAIN THE EMMITSBURG PIKE, ROUTE
15, IN FREDERICK COUNTY, AS A TRANSPORTATION FACILITIES
PROJECT.

(B)  THE AUTHORITY SHALL RECONSTRUCT, IMPROVE, AND
MAINTAIN THE PIKE IN CONFORMANCE WITH THE PROVISIONS OF THIS
TITLE; THE TRUST AGREEMENT, DATED AS OF JULY 1, 1978,
BETWEEN THE AUTHORITY AND MARYLAND NATIONAL BANK; AND THE
LAWS OF THE. UNITED STATES.

(C)  THE AUTHORITY MAY ENTER INTO OTHER TRUST
AGREEMENTS, PROVIDE FOR INTERRELATIONSHIPS BETWEEN TRUST
AGREEMENTS, AND TAKE OTHER ACTIONS NECESSARY TO RECONSTRUCT,
IMPROVE, AND MAINTAIN EMMITSBURG PIKE, ROUTE 15, IN
FREDERICK COUNTY, AS A TRANSPORTATION FACILITIES PROJECT.

(D)  THE AUTHORITY IN PREPARING OR REVISING ANY TRUST
AGREEMENT MAY PROVIDE FOR NO OR REDUCED TOLLS ON THE
EMMITSBURG PIKE TRANSPORTATION FACILITIES PROJECT AND
INCREASED OR MODIFIED TOLLS ON CERTAIN OTHER TRANSPORTATION
FACILITIES PROJECTS.

SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason in a
court of competent jurisdiction, the invalidity does not
affect other provisions or any other application of this Act
which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act
are declared severable.

SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1981.
