incomprehensible and, in any event, more limited
present provision that requires "filing with the
Board his affidavit of such facts".
8-313. INVESTIGATIONS; REPRIMANDS, SUSPENSIONS, AND
REVOCATIONS — GROUNDS AVAILABLE.
(A) INVESTIGATIONS.
THE BOARD SHALL INVESTIGATE AND TAKE APPROPRIATE ACTION
AS TO ANY COMPLAINT FILED WITH THE BOARD THAT ALLEGES THAT A
LICENSEE HAS FAILED TO MEET ANY STANDARD OF THE BOARD.
(B) REPRIMANDS, SUSPENSIONS, AND REVOCATIONS
GROUNDS AVAILABLE.
SUBJECT TO THE HEARING PROVISIONS OF § 8-314 OF THIS
SUBTITLE, THE BOARD MAY REPRIMAND ANY LICENSEE OR SUSPEND OR
REVOKE A LICENSE IF THE LICENSEE:
(1) FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A LICENSE FOR THE LICENSEE OR FOR
ANOTHER;
OR
(2) FRAUDULENTLY OR DECEPTIVELY USES A LICENSE;
(3) OTHERWISE FAILS TO MEET SUBSTANTIALLY THE
STANDARDS OF PRACTICE ADOPTED BY THE BOARD UNDER § 8-205 OF
THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second clause
of Art. 43, § 770(a)(3) and from Art. 43, §
770(a)(5).
In the introductory language of subsection (b) of
this section, the reference to the power of the
Board to reprimand a licensee is added to this
and, where necessary, corresponding sections of
other titles of this article, to state
specifically a power that is inherent in the
express power to suspend or revoke a license.
Subsection (b) (1) and (2) of this section is new
language added to conform to similar provisions
governing other health occupations in present
Art. 43. It states fundamental grounds for
disciplining a licensee. For examples of such
provisions in the present law, see present Art.
43, § 130(h)(1), as to physicians, and present
Art. 43, § 266A(c)(l)(iii), as to pharmacists.
See also § 8-403 of this title, which provides a
prohibition against selling, fraudulently
obtaining, or furnishing a license or practicing
as a nursing home administrator under any license
unlawfully or fraudulently obtained.
