Subsection (d) of this section is revised to
clarify that the Board has the power to establish
rules and regulations for continuing education
requirements.

8-312. REINSTATEMENT OF EXPIRED LICENSES.
THE BOARD SHALL REINSTATE THE LICENSE OF A NURSING HOME
ADMINISTRATOR WHO HAS FAILED TO RENEW THE LICENSE FOR ANY
REASON, IF THE LICENSEE:
(1) HAS NOT HAD THE LICENSE SUSPENDED OR
REVOKED;
(2) MEETS THE RENEWAL REQUIREMENTS OF § 8-311 OF
THIS SUBTITLE;
(3) PAYS TO THE BOARD THE REINSTATEMENT FEE SET
BY THE BOARD; AND
(4) SUBMITS TO THE BOARD SATISFACTORY EVIDENCE
OF COMPLIANCE WITH THE QUALIFICATIONS AND REQUIREMENTS
ESTABLISHED UNDER THIS TITLE FOR LICENSE REINSTATEMENTS.
REVISOR'S NOTE: This section is new language derived in
part from Art. 43, § 774(d).
Present Art. 43, § 774(d) refers to a nursing
home administrator "whose registration has
expired because he has temporarily abandoned the
practice ..., or has removed from the State, or
for any other reason .....". Since the present law
does not provide that the "license renewal"
expires solely because of abandonment of the
practice or leaving this State, the effect of the
law is as stated in the introductory clause of
this section, "a nursing home administrator who
has failed to renew the license for any
reason...".
The references to license renewal are substituted
for the references to registration to conform
with changes in terminology throughout this
title. See the General Revisor's Note to this
title.
The standard general provisions of item (4) of
this section reflect the broad rulemaking and
other powers of the Board under § 8-205 of this
title and are substituted for the somewhat
