VETOES

(b)  (1) The Department shall record the date and
findings of each inspection made under this section.

(2)  These records shall be public records open
for inspection under the provisions of Article 76A of the
Code.

(3)  The Department periodically shall publish
and make available to the public a list of dates that each
facility was inspected under this section.

(c) (1) The EXCEPT FOR THE PROVISIONS OF PARAGRAPH (2)
OF THIS SECTION, THE Secretary may delegate to the
appropriate health officer of any county OR MUNICIPALITY and
the health commissioner of Baltimore City all or any part of
the responsibility of performing the inspections required
under this section.

(2) ANY HEALTH OFFICER DELEGATED THE

RESPONSIBILITY TO PERFORM INSPECTIONS UNDER PARAGRAPH (1) OF
THIS SUBSECTION:

(2)  THE HEALTH OFFICER OF ANY COUNTY, OR THE
HEALTH COMMISSIONER OF BALTIMORE CITY, OR HIS DESIGNEE, MAY
INSPECT AND INVESTIGATE A SITE OR FACILITY THAT IS REQUIRED
TO HAVE A PERMIT UNDER § 8-1413.2 OF THIS SUBTITLE, OR FOR
WHICH A PERMIT IS ISSUED UNDER THAT SECTION, IF THE
INSPECTING HEALTH OFFICIAL:

(I)  UPON RECEIPT OF A COMPLAINT REPORTING
AN ALLEGED VIOLATION OF THIS SECTION, SHALL MAKE AN
IMMEDIATE INSPECTION OF THE FACILITY NAMED IN THE COMPLAINT;

(II)  PRIOR TO INSPECTING A FACILITY NAMED
IN A COMPLAINT, SHALL CONTACT THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE; AND

(III)  UPON COMPLETION OF THE INSPECTION,
SHALL FILE A WRITTEN REPORT WITH THE DEPARTMENT OF HEALTH
AND MENTAL HYGIENE ON THE FOLLOWING BUSINESS DAY AFTER THE
DATE OF INSPECTION.

(3)  THE WRITTEN REPORT SHALL DESCRIBE THE:
(I) COMPLAINT SOURCE AND THE TIME

RECEIVED;
CONTACTED;

(II)  NAME OF THE DEPARTMENT OFFICIAL

(III)  TIME AND LOCATION OF THE INSPECTION;

(IV) SUMMARY AND FINDINGS OF THE
INVESTIGATION; AND
