LAWS OF MARYLAND
Ch.8
THE APPLICANT MAY APPEAL A DECISION OF THE BOARD THAT
RELATES TO ISSUING OR RENEWING A LICENSE TO THE BOARD OF
REVIEW AS PROVIDED IN § 8-315(A) OF THIS SUBTITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
774(g).
The reference to an "appeal ... to the Board of
Review" is substituted for the present reference
to "appeal ... to the Secretary ... under
procedures established by the Board" to conform
with the present practice for nondisciplinary
cases. For the more general appeal, see § 8-315
of this subtitle.
The present reference to a "certificate of
registration" is deleted as unnecessary in light
of the reference to license renewal.
The attention of the General Assembly is called
to the fact that this provision allowing an
appeal to the Board of Review for matters that
relate to license issuance and renewal is unique
among all of the health occupations governed by
this article.
The attention of the General Assembly is called
also to the substitution of the reference to an
appeal of an application denial or a license
renewal for the present phrase "appeal from any
adverse action".
8-310. SCOPE OF LICENSE.
A LICENSE AUTHORIZES THE LICENSEE TO PRACTICE AS A
NURSING HOME ADMINISTRATOR WHILE THE LICENSE IS EFFECTIVE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last clause
of Art. 43, § 773(a). It is revised for clarity
and to conform with corresponding sections of
other titles of this article.
8-311. TERM AND RENEWAL OF LICENSES.
(A) TERM OF LICENSE.
A LICENSE EXPIRES ON THE SECOND ANNIVERSARY OF ITS
EFFECTIVE DATE, UNLESS THE LICENSE IS RENEWED FOR A 2-YEAR
TERM AS PROVIDED IN THIS SECTION.
(B) RENEWAL NOTICE.
AT LEAST 1 MONTH BEFORE THE LICENSE EXPIRES, THE BOARD
SHALL SEND TO THE LICENSEE, BY FIRST CLASS MAIL TO THE LAST
KNOWN ADDRESS OF THE LICENSEE, A RENEWAL NOTICE THAT STATES:
