NURSING HOME ADMINISTRATOR UNDER THE LICENSE IS RESTRICTED
TO A CERTIFIED INSTITUTION NAMED IN THE LICENSE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
773(e).
The phrase "through prayer alone" is added to
clarify the legislative intent to limit the
applicability of this section to certain types of
churches or religious denominations such as the
"First Church of Christ, Scientist". In this
regard, see Art. 43, § 136A, now § 14-102 of this
article — regarding physicians.
Although present Art. 43, § 773(e) does not refer
expressly to the issuance of limited licenses,
subsection (b) of this section would seem an
appropriate corollary of — if not implicitly
required by — the limited scope of the exemption
intended to be granted.
Subsection (e) of this section is new language
added to provide a mechanism for identifying
limited licenses.
The attention of the General Assembly is called
to the limited license concept discussed in this
section. While subsections (b) and (c) of this
section are new language, they provide the
mechanism to achieve the apparent "limited
license" intent of the General Assembly.
8-308. ISSUANCE OF LICENSE.
THE BOARD SHALL ISSUE A LICENSE CERTIFICATE AND A
LICENSE CARD TO ANY APPLICANT WHO MEETS THE REQUIREMENTS OF
THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
773(a) — except the last clause of that
subsection — and the first sentence of § 774(a).
The term "license card" is substituted for the
term in present Art. 43, § 774(a) "certificate of
registration" to conform to the actual practice
of the Board.
Art. 43, § 773(b), (c), and (d), which deals with
temporary licenses, is deleted as obsolete; in
this regard, see the General Revisor's Note to
this title.
