In subsection (d)(3) of this section, the phrase
"show knowledge of the laws and rules and
regulations that apply to nursing homes" is
substituted for the phrase "demonstrate his
proficiency in the rules and regulations of
health and safety" to delineate specifically the
areas where the applicant may be required to show
knowledge.

In subsection (f) of this section, the word
"authorized" is substituted for "approved", for
clarity.

8-306. WAIVER OF EXAMINATIONS.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
MAY WAIVE ANY EXAMINATION REQUIREMENT OF THIS TITLE FOR AN
INDIVIDUAL WHO IS LICENSED AS A NURSING HOME ADMINISTRATOR
IN ANY OTHER STATE.

(B)  CONDITIONS.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:

(1)  IS OF GOOD MORAL CHARACTER;

(2)  PAYS THE APPLICATION FEE REQUIRED BY THE
BOARD UNDER § 8-303 OF THIS SUBTITLE;

(3)  PROVIDES ADEQUATE EVIDENCE THAT:

(I)  AT THE TIME THE APPLICANT WAS LICENSED
IN THE OTHER STATE, THE APPLICANT WAS QUALIFIED TO TAKE THE
EXAMINATION THAT THEN WAS REQUIRED BY THE LAWS OF THIS
STATE; AND

(II)  THE APPLICANT QUALIFIED FOR A LICENSE
IN THE OTHER STATE BY PASSING AN EXAMINATION GIVEN IN THAT
OR ANY OTHER STATE.

(C)  RECIPROCITY.

THE BOARD MAY GRANT A WAIVER ONLY IF THE STATE IN WHICH
THE APPLICANT IS LICENSED WAIVES THE EXAMINATION OF
LICENSEES OF THIS STATE TO A SIMILAR EXTENT AS THIS STATE
WAIVES THE EXAMINATION REQUIREMENTS FOR INDIVIDUALS LICENSED
IN THAT STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 775.

In subsection (b)(3)(ii) of this section, the
phrase "or any other" state is added to provide
