Ch.8

(D)  SUBJECTS AND METHOD OF EXAMINATION.

(1)  SUBJECT TO THE PROVISIONS OF THIS
SUBSECTION, THE BOARD SHALL DETERMINE THE SUBJECTS, SCOPE,
FORM, AND PASSING SCORE FOR EXAMINATIONS GIVEN UNDER THIS
SUBTITLE.

(2)  THE SUBJECTS OF EXAMINATION SHALL BE RELATED
TO:

(I)  NURSING HOME ADMINISTRATION;

(II)  HEALTH ADMINISTRATION; AND

(III)  ATTENDANT MATTERS.

(3)  EACH APPLICANT SHALL BE REQUIRED TO SHOW
KNOWLEDGE OF THE LAWS, RULES, AND REGULATIONS THAT APPLY TO
NURSING HOMES.

(4)  THE SCOPE, CONTENT, AND FORM OF AN
EXAMINATION SHALL BE THE SAME FOR ALL LICENSE APPLICANTS WHO
TAKE THE EXAMINATION AT THE SAME TIME.

(E)  REEXAMINATION.

THE BOARD MAY NOT LIMIT THE NUMBER OF TIMES AN
APPLICANT MAY TAKE AN EXAMINATION REQUIRED UNDER THIS
SUBTITLE.

(F)  PARTICIPATION BY CONSUMER MEMBERS OF THE BOARD.

UNLESS AUTHORIZED BY THE BOARD, THE CONSUMER MEMBERS OF
THE BOARD MAY NOT PARTICIPATE IN ANY ACTIVITY RELATED TO
EXAMINATIONS UNDER THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §§
769(a)(3)(v) and 772.

Subsection (a) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article as discussed in the General Revisor's
Note to this article.

Subsection (c) of this section is standard
language added to conform with Board practice and
with present, similar provisions in Art. 43 that
govern examination for licensing by other health
occupation boards. It provides an element of
fundamental fairness by requiring the Board to
give qualified applicants notice before the
administration of examinations.
