the recording or broadcasting of certain other trial
court proceedings; permitting a certain judge to
regulate the use of certain recording and broadcasting
equipment in certain proceedings; and defining certain
terms.

Annotated Code of Maryland

(1980 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

5-308.

(A) (1) IN THIS SECTION, THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)  "EXTENDED COVERAGE" MEANS ANY RECORDING OR
BROADCASTING OF PROCEEDINGS BY THE USE OF TELEVISION, RADIO,
PHOTOGRAPHIC, OR RECORDING EQUIPMENT.

(3)  "LOCAL ADMINISTRATIVE JUDGE" MEANS THE
COUNTY ADMINISTRATIVE JUDGE IN THE CIRCUIT COURT AND THE
DISTRICT ADMINISTRATIVE JUDGE IN THE DISTRICT COURT.

(4)  "PROCEEDING" MEANS ANY TRIAL, HEARING,
MOTION, ARGUMENT, OR OTHER MATTER HELD IN COURT OR BEFORE
THE GRAND JURY.

(B)  EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS
SECTION, A JUDGE MAY NOT PERMIT EXTENDED COVERAGE OF ANY
TRIAL COURT PROCEEDING.

(C)  NOTWITHSTANDING THE PROVISIONS OF SUBSECTION (B)
OF THIS SECTION, A LOCAL ADMINISTRATIVE JUDGE MAY:

(1)  PERMIT THE USE OF ELECTRONIC OR PHOTOGRAPHIC
EQUIPMENT FOR THE PERPETUATION OF A COURT RECORD; AND

(2)  PERMIT AND REGULATE THE PRESENCE AND USE OF
CAMERAS, RECORDERS, AND BROADCASTING EQUIPMENT DURING
INVESTITURE OR CEREMONIAL PROCEEDINGS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
