(1)  Reduced below the rate prescribed on July 1,
1979; or

(2)  Adjusted by the Secretary of [Health and
Human Services] THE UNITED STATES DEPARTMENT OF AGRICULTURE,
as of the most recent July 1 under the National Child
Nutrition Act, and the per meal reimbursement is below the
adjusted rate.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

Dear Mr. President:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed Senate Bill 77.

This bill identifies the Secretary of the United States
Department of Agriculture as the federal official with the
authority to adjust the per meal reimbursement under the
National Child Nutrition Act.

Senate Bill 1032, which was enacted by the General
Assembly and signed by me on April 14, 1981, accomplishes
the same purpose.

Therefore it is unnecessary for me to sign Senate Bill
77.
