(C)  COMPENSATION AND REIMBURSEMENT FOR EXPENSES.
EACH MEMBER OF THE BOARD IS ENTITLED TO:

(1)  COMPENSATION DETERMINED BY THE SECRETARY IN
ACCORDANCE WITH THE STATE BUDGET, UNLESS THE MEMBER
OTHERWISE IS A PUBLIC EMPLOYEE; AND

(2)  REIMBURSEMENT FOR EXPENSES UNDER THE
STANDARD STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE
BUDGET.

(D)  STAFF.

THE BOARD MAY EMPLOY A STAFF IN ACCORDANCE WITH THE
STATE BUDGET.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
769(d), the second and third sentences of Art.
43, § 769(e), and the fifth sentence of Art. 43,
§ 769(f).

In subsection (b) of this section, the phrase "at
the times and places that it determines" is added
for clarity.

Subsection (c) of this section is revised to
clarify the apparent intent of the General
Assembly to exclude a "public employee" only
from per diem compensation. Although present
Art. 43, § 769(d) might be read to exclude public
employees from both compensation and
reimbursement for expenses, the current practice
is to allow appropriate reimbursements to them.

In subsection (c)(2) of this section, the phrase
"reimbursement ... as provided in the State
budget" is new language added to clarify that a
person has reimbursement rights only if provided
for in the State budget.

As to subsection (c) of this section, Standard
State Travel Regulations are adopted by the
Department of Personnel with the approval of the
Board of Public Works.

As to the current "full authorized membership" of
the Board, see § 8-202(a)(l) of this title.

The attention of the General Assembly is called

to subsection (c)(1) of this section, which

prohibits a public employee from being doubly

compensated. This exclusion is unique to the

Board of Examiners of Nursing Home
Administrators.
