only after being served with a written statement
of the charges and after a hearing before the
Secretary is deleted as repetitive of the basic
due process rights that a Board member charged
with the enumerated fault grounds would have
under Art. 24 of the Maryland Declaration of
Rights. In addition, the reference to a hearing
before the Secretary may be an unconstitutional
legislative modification of the constitutional
power of the Governor to remove Board members.

8-203. OFFICERS.

(A)  APPOINTMENTS.

FROM AMONG THE BOARD MEMBERS, THE GOVERNOR SHALL
APPOINT A CHAIRMAN AND VICE CHAIRMAN OF THE BOARD.

(B)  BOARD SECRETARY.

(1)  WITH THE CONSENT OF THE BOARD, THE BOARD
CHAIRMAN SHALL APPOINT THE BOARD SECRETARY.

(2)  THE BOARD SECRETARY MAY NOT BE A MEMBER OF
THE BOARD AND SERVES AT THE PLEASURE OF THE BOARD.

(3)  THE BOARD SECRETARY IS THE EXECUTIVE OFFICER
OF THE BOARD.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 43, § 769(e) and the first three
sentences of (f).

In, subsection (a) of this section, the phrase
"{f}rom among its members" is new language
added for clarity, in accordance with the current
practice of the Board.

The fourth sentence of present Art. 43, § 769(f),
which requires the Board secretary to be bonded,
is deleted as unnecessary since, in fact, all
State employees and officers are covered by a
blanket bond.

8-204. QUORUM; MEETINGS; COMPENSATION; STAFF.

(A)  QUORUM.

A MAJORITY OF THE FULL AUTHORIZED MEMBERSHIP OF THE
BOARD IS A QUORUM.

(B)  MEETINGS.

THE BOARD SHALL MEET AT LEAST TWICE A YEAR, AT THE
TIMES AND PLACES THAT IT DETERMINES.
