PRACTICAL NURSING AS REQUIRED UNDER § 7-505 OF THIS TITLE.

(C) PRACTICE MIDWIFERY.

A PERSON MAY NOT FAIL TO REPORT THE EMPLOYMENT OR
PLACEMENT OF A LICENSED NURSE MIDWIFE AS REQUIRED UNDER §
7-505 OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
301(a)(7).

Subsection (c) of this section is new language
added in light of the broad term "nursing" and to
conform to the inclusion of licensed nurse
midwives in § 7-505 of this title. This addition
is called to the attention of the General
Assembly.

7-710. PENALTIES.

(A) VIOLATIONS OF THIS SUBTITLE.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, A
PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS GUILTY
OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT:

$100; AND

(1) FOR A FIRST OFFENSE, TO A FINE NOT EXCEEDING

(2) FOR ANY SUBSEQUENT VIOLATION OF THE SAME
PROVISION, TO A FINE NOT EXCEEDING $500 OR IMPRISONMENT NOT
EXCEEDING 6 MONTHS OR BOTH.

(B) VIOLATIONS OF SUBTITLE 6 OF THIS TITLE.

A PERSON WHO VIOLATES ANY PROVISION OF SUBTITLE 6 OF
THIS TITLE IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS
SUBJECT TO A FINE NOT EXCEEDING $500.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §§
91(a) and 301(b).

In subsection (a) of this section, the reference
to a violation of "any provision of this
subtitle" is substituted for the literal language
of present Art. 43, § 301(b), which penalizes
only a violation of those items in present Art.
43, § 301(a) since the "additional" prohibitions,
which refer to certain representations, merely
elaborate on the prohibitions enumerated in Art.
43, § 301(a).
