THE NATURAL RESOURCES Article [39A] of the ANNOTATED Code
[of Public General Laws of Maryland].

18-6. Conveyance, etc., of property.

The Washington Suburban Sanitary Commission, a body
corporate, created by chapter 122 of the Acts of the General
Assembly of Maryland of 1918, be and is hereby authorized
and empowered to sell, lease, transfer, convey and dispose
of any of its real or personal property not considered by
the [said] commission necessary for the operation of its
water, sewerage, storm drainage or refuse systems upon such
terms and conditions as may in the opinion of [said] THE
commission be advantageous.

18-7. Penalties and enforcement by injunction.

(a)  Every act or omission designated as a misdemeanor
in this [Code] ARTICLE, unless otherwise provided, shall be
punishable before any trial magistrate or peoples's court or
the circuit court of the county within which such offense is
committed, and the offender shall, upon conviction, be
subject to a fine not exceeding [one hundred dollars
($100.00)] $100 or to confinement for not more than [thirty
(30)] 30 days in the county jail, or both, in the discretion
of the magistrate or court. Where such act or omission is
of a continuing nature and is persisted in, in violation of
the provisions of this [Code] ARTICLE or of any rule or
regulation formulated thereunder, a conviction for one
offense shall not be a bar to a conviction for a
continuation of such offense subsequent to the first or any
succeeding conviction.

(b)  Upon application of the Washington Suburban
Sanitary Commission, verified by oath or affirmation of a
member or employee thereof, the circuit court of any county,
sitting in equity, may, by injunction, enforce the
compliance with, or restrain the violation of, any order or
notice, or rule or regulation, of the commission made
pursuant to the provisions of this [Code] ARTICLE, or
restrain the violation or attempted violation of any of the
provisions of this [Code] ARTICLE, or require the compliance
with any of the provisions of this [Code] ARTICLE, by any
person, firm or corporation or require the entry of any
employee or agent of the commission within a designated area
upon the private premises and into any building in the
sanitary district where the commission shows a violation of
this [Code] ARTICLE. The court shall not require the
commission to post a bond. In the event the respondent in a
petition for injunction pursuant to this subsection is a
nonresident of the State of Maryland, process by publication
shall be effected pursuant to Rule 105 of the Maryland Rules
of Procedure.
