Licensed nurse midwives are included in this
section to conform with the uniform Board
practice regarding other licensees. This
revision is called to the attention of the
General Assembly.
In subsection (a)(2) of this section, the
reference to a private employer "who employs a
licensee for personal or family use" is added to
clarify the scope of reporting requirements for
private employers.
In subsection (b) of this section, the term
"license" number is substituted for the term
"recordation" number to clarify the duty of the
employer.
SUBTITLE 6. SPECIAL LICENSED NURSE MIDWIFE PROVISIONS.
7-601. SCOPE OF SUBTITLE.
(A) OTHER HEALTH OCCUPATIONS.
THIS SUBTITLE DOES NOT LIMIT THE RIGHT OF AN INDIVIDUAL
TO PRACTICE A HEALTH OCCUPATION THAT THE INDIVIDUAL IS
AUTHORIZED TO PRACTICE UNDER THIS ARTICLE.
(B) EMERGENCY SITUATIONS.
THIS SUBTITLE DOES NOT AFFECT AN INDIVIDUAL WHO IN AN
EMERGENCY AND WITHOUT COMPENSATION ATTENDS A WOMAN IN
CHILDBIRTH.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 43, § 83 and from Art. 43, §
93(b).
Subsection (a) of this section is rephrased to
reflect more accurately the state of the present
law and to conform to the language used in
similar provisions in other titles of this
article.
Present Art. 43, § 93(a), which exempts a
physician from the provisions of this subtitle,
is deleted as unnecessary in light of the broader
language of subsection (a) of this section.
The attention of the General Assembly is called
to the fact that subsection (b) of this section
may not be broad enough to cover policemen,
firemen, and other paid private and governmental
employees who on occasion, as part of their jobs,
perform acts that are within the practice of
midwifery. For analagous reasoning, see 64 Op.

Cushwa on October 31, 1979).
