LAWS OF MARYLAND
Ch.8
clarify that in addition to "licensing" nurse
midwives the Board under certain circumstances
may "certify" registered nurses to perform
additional acts as nurse midwives under § 7-205.
of this title.
Also in subsection (a) of this section, the
phrase "licensed by this State or certified by
the Board" is substituted for the reference to
certification by the American College of
Nurse-Midwives. This substitution clarifies that
a nurse midwife licensed by this State or
certified by the Board and, therefore, legally
practicing in this State could be entitled to
third party reimbursement while an individual not
licensed by this State or certified by the Board
and, therefore, not legally practicing in this
State is not eligible for third party
reimbursement. This revision is called to the
attention of the General Assembly.
Subsection (b)(3) of this section is new language
added to allow the Board to appoint separate peer
review committees for other nursing specialties
without the necessity of enacting new legislation
to amend this section.
For the substantive provisions that govern the
practice of midwifery, see Subtitle 6 of this
title.
7-505. EMPLOYER TO REPORT ABOUT LICENSEES.
(A) "EMPLOYER" DEFINED.
(1) IN THIS SECTION, "EMPLOYER" MEANS:
(I) A PUBLIC EMPLOYER;
(II) A PRIVATE EMPLOYER; OR
(III) AN EMPLOYMENT AGENCY.
(2) "EMPLOYER" DOES NOT INCLUDE A PRIVATE
EMPLOYER WHO EMPLOYS A LICENSEE FOR PERSONAL OR FAMILY USE.
(B) DUTY TO REPORT.
EACH EMPLOYER SHALL REPORT PERIODICALLY TO THE BOARD
THE NAME AND LICENSE NUMBER OF EACH LICENSEE EMPLOYED OR
PLACED TO PRACTICE REGISTERED NURSING, LICENSED PRACTICAL
NURSING, OR MIDWIFERY.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
294(a)(17).
