A LICENSED PRACTICAL NURSE MAY ADMINISTER TREATMENT OR
MEDICATION ONLY IF THE TREATMENT OR MEDICATION IS PRESCRIBED
BY AN INDIVIDUAL WHO IS AUTHORIZED BY LAW TO PRESCRIBE
MEDICATION OR TREATMENT.
(D) TEACHING OR SUPERVISING.
A LICENSED PRACTICAL NURSE MAY TEACH OR SUPERVISE
COMMENSURATE WITH THE EDUCATION AND DEMONSTRATED
COMPETENCIES OF THE LICENSED PRACTICAL NURSE.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
Art. 43, § 297(b), as that subsection applies to
the practice of licensed practical nursing by a
licensed practical nurse.
Subsections (b), (c), and (d) of this section are
new language derived without substantive change
from the first sentence of Art. 43, § 291(c) and
from the requirement of a team relationship, the
restrictions concerning administering treatment
and medication, and the restrictions concerning
supervision and teaching in the second sentence
of Art. 43, § 291(c).
In subsection (b)(2) of this section, the
reference to practicing licensed practical
nursing "only" in a team relationship is new
language added to state expressly a restriction
that is implicit in the second sentence of Art.
43, § 291(c).
Also in subsection (b)(2) of this section, the
reference that at least one team member be an
individual other than a licensed practical nurse
is added for clarity. This addition is called to
the attention of the General Assembly.
In subsection (c) of this section, the reference
to "an individual who is authorized by law" is
new language added to clarify who may prescribe
the medication and treatment that a licensed
practical nurse may administer.
In subsections (c) and (d) of this section, the
phrases "treatment or medication" and "teach or
supervise" are substituted for the phrases
"treatment and medication" and "teach and
supervise", respectively, to clarify that the
functions may be performed independently.
